We take your rights seriously. These general terms and conditions will help you understand your legal position while using our website and/or our application, hereinafter referred to as "Services." By using our Services, you agree to the terms and conditions below. These general conditions apply to all offers, orders, activities, agreements, etc. (including but not limited to) of Domaine Saint Jean. These General Terms are therefore concluded between, on the one hand, Domaine Saint Jean (hereinafter referred to individually as the "Merchant") and, on the other hand, individuals of legal age wishing to make a purchase via the Site (hereinafter referred to individually as the "Customer").

SERVICES

Through its Services, the Merchant provides a platform for communication, orders, and transactions to its end users. By using the Services, end users can place orders and optionally pay for them immediately.

PROTECTION OF MINORS

In accordance with Article L. 3342-1 of the Public Health Code, which prohibits the sale of alcohol to minors under the age of eighteen (18), the Customer agrees, when placing an order, to be at least eighteen (18) years old on the date of the order.

Alcohol abuse is dangerous for your health, to be consumed in moderation. The products sold on this merchant site contain alcohol and should be consumed in moderation.

RIGHT OF WITHDRAWAL

The end user has the right to withdraw from the purchase as long as the order has not yet been accepted by the Merchant. The Merchant reserves the right to refuse an order. As an end user, you will always be informed by email of the acceptance/confirmation or rejection of the order. Once the order is approved or confirmed, you no longer have the right to withdraw from your purchase as an end user. At the same time, the contract between the Merchant and the end user is finalized. The responsibility for uncollected orders may still be attributed to the end user. In the case of delivery, the end user will do their best to receive the product(s) at the time specified when ordering. If the end user is unable to receive the product at the indicated time, they must contact the Merchant at least 2 hours in advance.

The Merchant has only a best-efforts obligation regarding access, the ordering process, delivery, or other services. At any time, the Merchant has the right to delete or disable the store, in whole or in part, for maintenance, updates, or any other reason, even without prior notice.

ORDER PICKUP/DELIVERY

The pickup location is indicated when you place your order. The delivery location is the address you specified when ordering. Merchants are always responsible for preparing and providing your order on time.

The end user must always verify the accuracy of the order immediately upon receipt. Any problem or defect that constitutes a quality issue must be reported immediately upon receipt of the order to the Merchant, failing which the end user will forfeit any rights in this regard. The burden of proof rests on the end user.

The Merchant is not responsible for delays and/or failure to fulfill the contract in cases of force majeure, difficulties during a partial or full strike, server issues preventing the order from being processed, problems with transport or communication entities, floods, fires, website unavailability, payment partner issues, natural disasters, etc. (non-exhaustive list).

The Merchant is not responsible for the misuse and/or inappropriate use of the product, for example, during improper transportation or due to any act or intentional fault by any person, including the end user or their representative.

PRICES AND PAYMENT

The prices visible through our Services apply. The Merchant is responsible for the prices displayed for its products.

All prices include VAT (where applicable) but do not include any additional fees (e.g., delivery fees) that may be added to the total amount of the order placed by the end user. The Merchant is responsible for updating these prices and modifying them if necessary.

The end user's order will not be processed or forwarded to the Merchant if payment has not been authorized. This does not apply if the end user has not opted for online payment.

REFUND POLICY

Our products and activities are subject to specific conditions due to their nature. Please carefully read our refund and modification policy.

  1. Non-Refundable Products
    All products sold are non-refundable. We encourage you to carefully verify the information before finalizing your purchase. If a product is damaged or defective upon receipt, please contact us within 7 days to find an appropriate solution (exchange or repair).
  2. Non-Refundable Activities
    Reserved activities are not eligible for a refund, regardless of the reason for cancellation.
  3. Modifying the date of an Activity
    You can modify the date of your activity up to one week before the scheduled date, subject to availability. To make this change, please contact us by phone at +33 6 08 28 08 74. After this deadline, no modifications can be made.
  4. Legal Exceptions
    This policy does not affect your legal rights, particularly in the event of a defective or non-compliant product.

INTELLECTUAL PROPERTY

The information provided on the Site may only be used for strictly personal purposes.

Any use for commercial purposes or any other purpose is strictly prohibited.

In addition, the elements present on the Site are protected by the Intellectual Property Code relating to copyright protection. Therefore, any modification, representation, and reproduction, in whole or in part, for purposes other than private use, are strictly prohibited. This prohibition applies regardless of the method of reproduction, representation, and/or modification, and for any duration.

In general, the Merchant cannot be held responsible for any direct or indirect damage resulting from the prohibited use of the information or any other element provided by our Services.

INFORMATION

The Merchant is responsible for ensuring the accuracy of product information and ensuring it is complete. Products are displayed as accurately and authentically as possible. Images are created with great care but are indicative only, intended to facilitate the end user's choice. Please note that the actual products may visually vary in color, volume, and shape.

COMPLAINTS

In the event of a dispute between the Customer and SCEA Domaine Saint Jean, both parties will attempt to resolve it amicably (the Customer shall submit a written complaint to the professional).

If an amicable agreement cannot be reached or if there is no response from the professional within a reasonable period of one (1) month, the consumer Customer, as defined by Article L.133-4 of the Consumer Code, may refer the matter free of charge to the competent mediator listed on the list of mediators established by the Commission for the Evaluation and Control of Consumer Mediation in accordance with Article L.615-1 of the Consumer Code, namely:
